Wedding Photography Terms & Conditions
Plain English.
With regard to this document the terms we, us, our and ourselves refers to David Paul Photography. The terms you, your and yourselves refers to the persons specified as Partner 1 and Partner 2 on the booking form.
Copyright.
The copyright Designs and Patents Acts assign the copyright of the images to us.
License, Coverage and Reproduction.
Photographs taken during the course of the event will be at our discretion although every effort will be made to comply with your requirements. We shall be granted artistic license in relation to the poses photographed and the locations used. Our judgement regarding these matters shall be deemed correct. We shall endeavour to photograph all individuals as requested but we accept no responsibility for leaving someone out. For a booking involving a church ceremony or at certain venues our movements are sometimes restricted by the official in charge. The position from which we cover the ceremony may not be our choice and therefore we cannot accept responsibility for an obstructed view. Due to a variety of lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of photographs. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, we will not be responsible for photographs that are not produced due to technical failure.
Prices.
All goods and services specified on the booking form are supplied at the prices ruling on the date of booking. All goods and services not specified on the booking form are supplied at the prices ruling at the time of receipt of the order.
Booking Fee.
The £300 booking fee is to the save the wedding date for you so no other person books us and is non refundable. It is fully deductable from the package price.
Payments.
A booking fee will confirm your reservation, as well as full acceptance of the terms and conditions as published on our website. The booking fee will be deducted from the cost of your chosen package (as detailed on the booking form) when calculating the final balance due. Payment in full of the remaining balance will be due two months before the wedding date. This payment must be paid via online banking else a 3% service charge will be added. Payment for the pre-wedding shoot (PWS) will be due two calendar months before the agreed date of the PWS. Additional goods ordered must be paid for in full at the time of ordering. Titles to all goods remains with us until paid for in full.
Unforeseen Circumstances.
If David or Claire are unable to attend on the wedding date due to unforeseen circumstances or any cause beyond their reasonable control (e.g. illness, injury, victim of crime, flooding etc.) then the wedding will be photographed by the unaffected partner alone. If both David and Claire are unable to attend, every effort will be made to send a trained replacement photographer as cover. In the event of cancellation by ourselves, or in the very unlikely event of total photographic failure, liability shall be limited to a full refund of any fees paid.
Cancellation.
Cancellation must be done in writing or via e-mail. If you cancel up to three months before your wedding date, you shall forfeit the booking fee only . If you cancel within the final three months leading up to your wedding date, the remaining balance as specified on your initial invoice becomes due immediately and must be paid within seven working days.
Ownership.
We retain copyright over all our photographs and all computer files remain our property. We will supply you with a copy of our professionally edited photographs (from your wedding day) for your own non-commercial purposes. All images supplied will be non-watermarked and high resolution.
Rescheduling.
If your wedding needs to be rescheduled for any reason, and if indeed we are available on the new date, the remaining balance must be paid in full prior to the transfer.
Product Availability.
In the event of a product being no longer available, such as an album, a suitable alternative of similar quality will be offered. Our choice of alternative will be deemed correct and acceptable.
Archive & Six Month Rule.
We will store the wedding photographs for a maximum of six months from the date of your wedding. It is therefore imperative that you download the wedding photographs ASAP once you have received the link and subsequently backup. If your package includes an album, you must also order it within this six month period else the product is forfeit. If you require access to the photographs after the six month period, then a £100 archive fee is payable to retrieve the images, if indeed they are still available.
Official Photographers.
We are the only authorised and official photographers for your wedding day.
Timings.
On your wedding day, we start our cover two hours before the main ceremony and no earlier than 9AM. We finish our cover shortly after the first dance and no later than 8.30PM.
Provision of Food.
Two hot meals must be provided for the photographers at the same time as the wedding breakfast, preferably two bar meals if available at your venue.
Preparation Photos.
Preparation photos are only done for Partner 1 unless Partner 2 is getting ready at the same location. This is because both photographers travel in the same car.
Amateur Photographers.
We have no objection whatsoever to wedding guests taking photos during the course of the wedding day. However, we do not accept being shadowed by keen amateur photographers. This is because they often get in our way and reduce the quality of the finished product we provide.
Wedding Breakfast.
No photography takes place during the wedding breakfast apart from to document the couple's entrance, the speeches and the cake cutting.
Pre-Wedding Shoot with optional Guest Book.
The pre-wedding shoot (PWS) takes place in and around Llangollen, Denbighshire. It is your responsibility to select the required number of photographs for the guest book and notify us in good time (at least two months before the wedding date). If your selection is not received, we will be unable to organise the manufacture of the guest book and the product will be forfeit. We accept no responsibility whatsoever for damage caused to/by the guest book during the wedding day. The guest book is supplied “as is” and all use is at your own risk.
Accidental Damage & Personal Injury.
Although we strive to make each directed photoshoot as safe as possible, we cannot be held responsible for any accidental damage or personal injuries. It is understood that the client undertakes each photoshoot at their own risk.
Album Delivery.
All wedding albums are delivered direct from the manufacturer free of charge via courier.
